Terms of Service
1. Acceptance
By downloading, installing, or using the Cooing app ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is provided by Commixing Research and Development pvt. ltd. ("we", "us", "our").
2. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent that you are 18 or older.
3. The Service
Cooing provides an audio monitoring service that streams audio peer-to-peer between two devices on the same Wi-Fi network using WebRTC. The App is a supplemental tool and is not a substitute for in-person supervision of an infant or child. You are solely responsible for the safety and welfare of any child in your care.
4. Safety Disclaimer
IMPORTANT: Cooing is a monitoring aid only. Push notifications, heartbeat monitoring, and audio alerts depend on network connectivity, device battery, and software behaviour, none of which can be guaranteed at all times. Do not rely solely on Cooing for child safety. Always ensure alternative supervision methods are in place.
5. Account
- You are responsible for keeping your account credentials secure.
- You must not share your account with others or use another person's account.
- You must notify us immediately if you suspect unauthorised access to your account.
6. In-App Purchases
Plus and Pro tiers are available as one-time lifetime purchases via the Apple App Store (iOS) or Google Play (Android). All purchases are subject to the relevant platform's terms and refund policies. We do not process payments directly. Purchases are tied to your Cooing account and can be restored on reinstall or new device.
7. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble the App.
- Use the App to monitor individuals without their knowledge or consent.
- Attempt to circumvent tier restrictions or in-app purchase verification.
- Use the App in any way that violates applicable law.
8. Intellectual Property
All content, trademarks, and code in the App are owned by or licensed to Commixing Research and Development pvt. ltd. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ALL TIMES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING ANY HARM RESULTING FROM RELIANCE ON THE APP FOR CHILD SUPERVISION.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time via Settings → Delete Account. Deletion is permanent and irreversible.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification. Continued use after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
